What is a Divorce in New Jersey?

Divorce is the dissolution of a marriage. In New Jersey, the focus is not upon fault but, instead, the economic disunion of a couple and family.


What is Physical Custody in New Jersey?

Physical Custody generally is a reference to where the child lives. The parent with whom the child resides is called the Parent of Primary Residence and the other parent is called the Parent of Alternate Residence. Sole Physical custody can exist.

Child Support refers to the payment of by one-spouse to another to address the economic needs of the children. Child Support is determined by a formula called the Child Support Guidelines (for income below a substantial threshold). The Child Support Guidelines consider income of both parents, Alimony paid by or received by a parent, overnight Parenting Time and health and child-care expenses of the children.


What is Equitable Distribution in New Jersey?

Equitable Distribution refers to the fair distribution of assets and liabilities acquired during the marriage.


How does a Divorce End in New Jersey?

A Divorce in New Jersey ends in either a Divorce Agreement or a Trial. Most cases end in a settlement.
