In a Decision – R.L. v. M.H. (an "Unreported Decision") >> the Court Held:
The Appellate Division determined that a Domestic Violence finding was NOT warranted where the victim appeared at a non-scheduled day to retrieve belongings and where the parties were divorced, the victim had removed her belongings and were without children such that they were unlikely to be in contact with each other.
The parties were granted a final judgment of divorce, all plaintiff's belongings were removed from the marital home, and plaintiff testified her name is no longer on the lease. Additionally, the parties do not have children. There is nothing in the record to demonstrate an ongoing potential for contact and the record does not support the entry of a FRO to protect plaintiff from further abuse.
