In a Decision – Orr v. Johnson, (an “Unreported Decision") >> the Court Held:
The Appellate Division held that it needed to be determined whether New
Jersey had jurisdiction under the "significant connection" and "substantial evidence" tests of the Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA), N.J.S.A. 2A:34-53 to -95 and not an agreement of the parties..
Parents signed a Custody and Parenting Time Agreement providing for joint legal custody, designating plaintiff as the parent of primary residence, New Jersey as child's domicile and New Jersey jurisdiction. The Appellate Division determined that the trial court erred in relying on the agreement to determine custody and remanded for a hearing on the factors under the Uniform Child Custody Jurisdiction and Enforcement Act.
