In a Decision – Ben-Haim v. New Israel Fund, (an "Unreported Decision") >> the Court Held:
The Appellate Division reversed the Trial Court’s determination that New Jersey had jurisdiction where all the connections of the children were in Pennsylvania where the child had resided notwithstanding the New Jersey Divorce.
The parties were divorced by way of a default final judgment of divorce. As part of the FJOD, the parties executed an interspousal agreement that resolved all issues including custody. Subsequent to the entry of the FJOD, the child resided in Pennsylvania with defendant. After defendant overdosed on prescription medication the trial judge entered an order that determined that New Jersey had jurisdiction over the child and awarded sole physical custody to plaintiff.
