The Appellate Division determined that Domestic Violence occurred when the Ex-Husband threatened the Ex-Wife on the telephone and sending her threatening messages via a mutual friend as well as text messages at all hours of the day and night. The Ex-Husband Committed Domestic Violence by repeatedly making threats and derogatory comments with purpose to alarm or seriously annoy the Ex-Wife.
The court affirmed holding that the Ex-Husband was threatening the Ex-Wife on the telephone and sending her threatening messages via a mutual friend as well as text messages at all hours of the day and night and where similar threats and name calling spanned a nearly two-year period.
