In a Decision – Halonski v. Halonski, (an "Unreported Decision") >> the Court Held:
The Appellate Division reversed the Trial Court’s utilization a mortgage
principal paydown reduction based upon the terms of the Divorce Agreement.
The Motion Court failed to interpret the Divorce Agreement and discern how the parties intended to credit Husband for his monthly mortgage payments. The court instead credited in an amount the court deemed equitable based on the parties' relative contributions to the mortgage payments. Because the language employed in the Divorce Agreement is subject to different interpretations, we remand for the motion court to determine what the parties intended when they negotiated and agreed upon the principal pay-down credit provision in the Divorce Agreement.
