The Appellate Division remanded the Trial Court determination denying relocation.
The trial judge found all testimony to be credible. The judge denied defendant's relocation application, allowing the child to remain with defendant unless she relocated to Pennsylvania, in which case plaintiff would gain sole physical custody.
The Appellate division found the judge did not adequately explain why one expert's opinion was rejected when both were deemed credible. The court also noted the judge improperly issued a self-executing order without an end date and without an assessment of future circumstances.
