In a Decision – N.M. v. J.M., (an "Unreported Decision") >> the Court Held:
The Appellate Division reversed the Trial Court decision that maintained
Joint Custody even though Wife demonstrated a basis for Sole Custody.
The Trial Judge applied the appropriate statutory factors and concluded that based on the law, joint custody appeared to be "totally inappropriate." Yet, the Trial Judge ordered that the parties continue to have joint custody because the Trial Judge worried that awarding Wife sole custody would further erode Husband's relationship with the children. As the record reveals, and as the judge properly found, there appears to be "no reasonable prospect within the foreseeable future that the parties will be able to agree, communicate and cooperate."
