In a Decision – Dep't. of Children and Families v. H.V. (an Unpublished Opinion) >> the Court Held:
The Appellate Division determined that the mother admitted she consumed alcohol, coupled with averting her attention from the road, caused her vehicle to overturn, injuring the child. Moreover, despite the purpose of the alcohol tests, the accuracy was reliable. As a result, actual harm occurred to the child and there was imminent risk demonstrated by appellant's act of driving while under the influence of alcohol. Accordingly, the court affirmed a finding of gross neglect.
