In a Decision – S.E. v. B.S.B. . (an "Unreported Decision") >> the Court Held:
The Appellate Division held, that the trial court did not abuse its discretion in emancipating the child when he turned age 23 even though the child suffered from a disability.
The court found that the plaintiff had the burden of rebutting the presumption of emancipation as a matter of law when a child reaches the age of twenty-three and the plaintiff had failed to sustain that burden.
