In a Decision – B.G. v. P.G., (an "Unreported Decision") >> the Court Held:
The Appellate Division reversed the Decision of the Trial Court and determined that if true, the Husband’s factual issues that, if true, may constitute fraud, misrepresentation, or other misconduct by Wife.
The Appellate Division determined that the Consent Order was sent to Husband while imprisoned who signed and returned the order to Wife’s counsel. When Husband was released from prison in December 2018, he moved pursuant to Rule 4:50-1 to vacate the January 17, 2018 consent order, arguing fraud, lack of capacity, and inequity. The Appellate division found that the trial court abused its discretion when it denied Husband's motion without holding an evidentiary hearing.
