The Appellate Division reversed the Decision of the Trial Court’s over all decision, because, in part, the Trial Court failed to rule on a Motion filed.
The Appellate Court found that the trial court's failure to address plaintiff's motion was a dereliction of the trial court's responsibility to conscientiously respect the right of plaintiff to be heard. The trial court had acknowledged that a motion for pendente lite support had been filed years earlier by plaintiff but ruled that in light of the ongoing voluntary support being paid by defendant, the motion would not be entertained by the trial court.
