The Appellate Division determined that as the parties had agreed to their Divorce Agreement acknowledging incomplete Discovery barred a claim to reopen Discovery after the Divorce.
The parties entered into the Divorce Agreement with a mutual understanding that discovery was incomplete. This understanding was specifically set forth in the Divorce Agreement itself, which also made specific mention of plaintiff agreeing to a set monthly payment with respect to defendant’s pension without having all information related to the pension value. The court also noted plaintiff’s belief that defendant fraudulently withheld information was purely speculative.
