In a Decision – L.N. v. G.D. (an "Unreported Decision") >> the Court Held:
The Appellate Division determined that the Trial Court did not properly consider the history of Domestic Violence notwithstanding their continued residence together.
Husband and Wife shared a home with their children, but had been using separate bedrooms during their divorce. The parties had an argument over their scheduled time with their children. Wife entered Husband’s bedroom to retrieve items for her room. Husband suspected that Wife was recording him. Husband forcibly wrested away Wife’s phone, causing her injury in the process. The trial court noted that Wife continued to reside in the marital home and had not previously sought a restraining order despite her claims of prior violence by Home The Appellate Division found that found that the trial court found, among other things, no immediate danger to Wife without assessing the prior history of domestic violence, and placed undue weight on the fact that Wife had not previously sought a restraining order despite allegations of domestic violence
