In a Decision - L.G. v. T.G., (an "Unreported Decision") >> the Court Held:
The Appellate Division affirmed the Trial Court Decision that it was Domestic Violence for the Husband to have a GPS tracker installed on Wife’s car.
The trial judge determined that stalking occurred for purposes of Domestic Violence in that the information obtained through the device led defendant to intentionally harass plaintiff by questioning her about her activities and that there was regular serious abuse. Defendant argued his authorization to place the tracking device on the car did not constitute stalking because he did not personally install it, he never threatened plaintiff, he did not personally maintain visual and physical proximity to her and his behavior was not persistent since the tracking occurred over a one week period. The Court determined that the evidence showed the tracking device was on the car for a month, data was retrieved from it 88 times and the investigator physically followed her for at least three days.
