In a Decision – Rednor v. Rednor, (an "Unreported Decision") >> the Court Held:
The Appellate Division reversed the Trial Court and held that the disabled
daughter’s condition was such as to potentially allow for the
unemancipation notwithstanding that the Case Management order in one-sentence said the child was emancipated.
The Consent Case Management Order signed by the parties' attorneys stated the children were emancipated but also stated their physical and emotional conditions required continued direct support. Three months later one child suffered a brain hemorrhage that left her disabled and living with defendant. Trial judge rejected the motions and found parties knew of disabled daughter's condition at the time of the MSA and the alimony award factored in certain costs for daughter. The Appellate Division determined that trial judge erred in ruling disabled daughter was emancipated based on one sentence in the case management order, erred in construing N.J.S.A. 2A:17-56.67 as requiring a weekly support obligation to trigger its application and should have held a plenary hearing.
