The Appellate Division determined that Defendant committed the predicate act of assault and that Plaintiff was in need of protection.
The trial judge noted appellant picked up a heavy fruit bowl, ran toward respondent, and threw it directly at her “with full force” from a close distance. Further, the history of domestic violence between the parties, and the existence of immediate danger, substantiated the judge’s determination that a final restraining order was necessary to prevent future acts of domestic violence.
