In a Decision A.T.M. v. S.M., (an "Unreported Decision") >> the Court Held:
The Appellate Division reversed the Trial Court determination.
The Appellate Division found that notwithstanding that the trial court scheduled the trial date, and Plaintiff failed to appear for trial, the trial court should not have entered default judgment. Plaintiff was entitled to notice of the proposed final default judgment and thus the court erred in holding the default hearing the day following plaintiff's failure to appear for trial.
