The Appellate Division affirmed the Trial Court decision as the findings were binding as they were supported by adequate, substantial, credible evidence.
The Appellate Division noted the long-standing policy of favoring the use of voluntary agreements to resolve marital disputes. The lower court judge had found there was no substantial change in
circumstances to warrant an alimony increase. The record also showed Wife's unemployment
appeared voluntary which should not inure to her benefit.
