In a Decision – R.S.B. v. K.J.Z., (an "Unreported Decision") >> the Court Held:
The Appellate Division affirmed the Trial Court decision and set forth that
Acts of Harassment without Physical Acts are sufficient for Domestic
Violence.
Defendant, a police officer, was engaged in an extra-marital affair with Plaintiff, a married woman. The Court stated that that harassment was one of the listed predicate acts in the Domestic Violence Act. The court affirmed the trial court's conclusion that Defendant's suicidal threats combined with brandishing a firearm while speeding down the highway was sufficient to constitute harassment since it evidenced a purpose to alarm plaintiff. The court further affirmed the trial court's conclusion that a Final Domestic Violence order was necessary to protect Plaintiff, given Plaintiff's testimony about Defendant's pattern of threatening to harm himself or harm Plaintiff's husband giving rise to her fear that Defendant would come to Plaintiff's home or her children's school.
