In a Decision – Polimeni v. Polimeni, (an "Unreported Decision") >> the Court Held:
The Appellate Division reversed and remanded the denial of Child Support determination and denial of Custody determination as it is the Court’s obligation to consider the statutory factors where Plaintiff no longer exercised parenting time and the children resided with Defendant.
The statutes say the court "shall consider" the factors. This statutory obligation is not optional. The judge correctly pointed out that Defendant filed incomplete papers on his Motion.
