The Appellate Division determined that the Divorce Agreement only provided for a determined date to consider Life insurance based upon premium costs and not upon Retirement.
The Appellate Division affirmed holding the Divorce Agreement clearly indicated the parties intended to reevaluate the life insurance policy when Husband reached the age of sixty-two because of premium increases; nowhere in the document was there an indication that Husband intended to retire or renegotiate alimony at that age.
