The Appellate Division vacated the finding of Domestic Violence and reversed and remanded because the trial judge never analyzed whether daughter's and mother's testimony regarding prior abusive conduct to family members was admissible. The inadmissible testimony made it impossible to tell if the judge's credibility findings were tainted. The trial judge also failed to explicitly conclude that Defendant acted with the purpose to harass daughter.
The court found that the admission of this evidence, without conducting the proper analysis, suggested Defendant was predisposed to "a pattern of abuse," contrary to the limits of admissible evidence, and had the clear capacity to bring about an unjust result.
