In a Decision – Malhan v. Myronova, (an "Unreported Decision") >> the Court Held:
The Appellate Division affirmed the Trial Court finding that a Professional in a divorce cannot be sued for advice rendered.
Therapist was appointed to provide therapy to children during the divorce action and report her recommendations to the court. She was entitled to protection under the litigation privilege even if she was not court appointed because her statements directly related to an object associated with the divorce action, the best interests of the children.
The Appellate Division found that the litigation immunity doctrine applied to medical defendants because they were authorized by law to assist court in determining the best interests of the children.
