The Appellate Division affirmed the Trial Court determination of Domestic Violence and utilization of the recalled judge.
Defendant argued that the trial court judge should not have been recalled to sit on the case after the judge was not reappointed by the governor at the expiration of his term and had not retired..
The Appellate Division noted that the trial judge was retired on pension and was recalled for temporary service. The court ruled that neither the New Jersey Constitution nor the recall statute required reappointment by the governor for a retired judge to be recalled to temporary service.
