The Appellate Division vacated and remanded the case and set forth that Pennsylvania law determined that Husband had no duty of support under Pennsylvania law.
Because Pennsylvania issued the initial child support order, its law should have been applied to determine the duration of Husband's child support obligation. Because the parties' son was over eighteen and graduated high school, Husband was not required under Pennsylvania law to continue to pay child support for him. The substantive law of Pennsylvania does not require a parent to pay child support for children who are over eighteen after they graduate high school
