In a Decision – K.S. v. J.S. (an "Unreported Decision") >> the Court Held:
The Appellate Division could not sustain the judge's reliance on dissipation of assets.
The Appellate Division determined that Plaintiff did not voluntarily dissipate the assets in the Fidelity account with the intent to diminish defendant's share in the marital estate. Additionally, plaintiff did not engage in any unapproved action to use the funds for his own benefit.
