In a Decision – C.R. v. J.R. (an "Unreported Decision") >> the Court Held:
The Appellate Division determined that a Final Restraining Order was in order notwithstanding the mutual physical fight based upon Harassment (which constituted domestic violence for the purpose of issuing a Final Restraining Order).
Girlfriend testified that, on the day of the incident, boyfriend phoned her at least 50 times and sent her more than 50 text messages. As she left her workplace, girlfriend asserted boyfriend grabbed her neck, pulled her hair, and dragged her towards his car, while he hit her in the head with his fist. In opposition, boyfriend countered that girlfriend was the aggressor, assaulting him. The Trial court noted the great disparity in the parties’ testimony and commented “you both can’t cause an assault when you both engage freely into the fight.” The Trial Court issued a Domestic Violence Order determining such was necessary since the parties lived across the street from one another and boyfriend had continued to harass girlfriend through social media posts
