The Appellate Division remarked that "not established" and ‘unfounded” were one of the outcomes of an investigation of abuse or neglect. The Appellate Division stated that a finding of "not established" if there was not a preponderance of evidence that a child was abused or neglect, but there was evidence the child was harmed or placed at risk of harm. The court further noted that a parent was only completely cleared of wrongdoing by a finding of "unfounded", in which the evidence established that a child was not harmed or placed at risk of harm.
