In a Decision – D.C.C.P. v. B.A., . (an "Unpublished Decision") >> the Court Held:
The Appellate Division determined that there was no credible evidence in the record that mother was prescribed Subutex or that her use of Subutex during her pregnancy was authorized by a qualified physician after full disclosure. Additionally, the court noted that her use of Subutex was not in conjunction with any bona fide treatment program. As a result, the evidence established that the child's physical, mental or emotion condition had been impaired or was in imminent danger of becoming impaired as a result of appellant's failure to exercise a minimum degree of care. As a result, the court determined that the mother abused or neglected the child pursuant to N.J.S.A. 9:6-8.21(c)(2) and N.J.S.A. 9:6-8.21(c)(4)(b).
