In a Decision – T.Z. v. J.J ., (an "Unreported Decision") >> the Court Held:
The Appellate Division determined that as Mother was financially and otherwise capable, Mother would be the custodial parent.
Mother voluntarily gave temporary custody of children to Grandmother in 2017 with the understanding mother would take the children back when her financial situation improved. Trial judge properly determined that mother was fit to parent her children, had adequate living accommodations and had secured school and daycare arrangements for them and plaintiff did not satisfy the two-step analysis used when a third party sought custody over a natural parent.
