The Appellate Division affirmed the Trial Court decision to alter the Parenting Time arrangements without a plenary hearing..
The Appellate Division determined that there was no genuine dispute of material facts requiring a plenary hearing, and the modification was in the best interests of the parties' son. The parties had moved since the divorce and were now located 90 minutes apart (even though one parent said that that parent would move to the same town).
