The Appellate Division determined that the Stock option in question was based upon past performance and thus evenly distributed to the Wife.
The Appellate Division affirmed holding the employment promotional grants were based on performance ratings at the time, in recognition of appellant’s efforts, and no document provided to the court stated appellant must meet any given performance goal to trigger the vesting of the units. Therefore, the restricted share units were subject to equitable distribution.
