The Appellate Division remanded the matter to the Trial Court for a Plenary Hearing where two equally plausible interpretations of a clause in a divorce Agreement was possible.
Husband appealed from a post-judgment order requiring him to pay Wife additional alimony based on his total income, which included income from restricted stock units that were equitably distributed pursuant to the terms of their Divorce Agreement. The Appellate Division determined that inasmuch as both parties' readings of how the restricted stock units would factor into the alimony calculation equally plausible, the court found a plenary hearing necessary in order to determine the intent of each party at the time the Divorce Agreement was signed.
