The Appellate Division affirmed the Trial Court’s determination that the mediated written settlement was enforceable. Husband’s complaints as to the fairness and information provided did not defeat a mediated settlement. The Appellate division agreed with the Trial Court. (A reversal as to an item of unrelated relief did occur.)
Defendant asserted that the parties' mediation did not provide him with any benefit and was entered without knowledge of important information. Defendant requested his alimony be reduced due to a reduction in earnings. The trial court denied defendant's requested relief, finding the parties voluntarily participated in mediation at defendant's request and that the parties' agreement was without fraud or compelling circumstances. The trial court characterized defendant's cross-motion as an effort to renege on the parties' settlement. The trial court determined that there was nothing unconscionable about the mediated settlement and that defendant was in possession of the financial information.
