The Appellate Division affirmed the Chancery Division conclusion that because Husband/Father did not maintain applicable Life Insurance for his children (child support) the Estate of Husband/Father is liable.
Husband/Father obtained Life Insurance that contained a “suicide exclusion”. Husband/Father committed suicide. Because the suicide Husband/Father barred recovery of the life insurance proceeds, he failed to “maintain” life insurance and therefore breached the Agreement.
