The Appellate Division reversed the Trial Court because the misreading of
Intentions could not exist.
The Appellate Division ruled that the trial court misapplied the standard in concluding that defendant had misinterpreted plaintiff's intentions, noting that a sleeping person could not affirmatively consent to intercourse. The court further rejected the trial court's conclusion that plaintiff no longer required protection from a restraining order, holding that defendant's commission of a violent act alone established the need for a Domestic Violence Order.
