The Appellate Division determined that there was no precedent for the right of first refusal he sought (that it was in the children’s best interests to be with their father when their mother was at work and unavailable to care for them). It was determined that given the acrimonious nature of the parties, it was in the best interests of the children to maintain a well-defined custody arrangement and continue the court’s careful determination.
