The Appellate Division vacated and remanded the Trial Court finding because there was no evaluation of the factors for a finding of Domestic Violence.
Plaintiff filed for a TRO alleging defendant was harassing her by constantly violating the civil restraining order through text messages and coming to her house unannounced. She also alleged defendant made false reports of child abuse and verbally threatened to hurt her. Defendant admitted texting plaintiff after she told him not to.
The Appellate Division remanded for Trial court did not evaluate the statutory factors and made no express findings as to whether an FRO was necessary to provide protection for the victim.
