In a Decision – Ben-Haim v. Edri, (an "Reported Decision") >> the Court Held:
When the family traveled together to Israel Wife filed for divorce in an Israeli rabbinical court and obtained an order prohibiting Husband from leaving Israel until the divorce was finalized. The rabbinical court later lifted that order, permitting Husband to return to New Jersey. Husband filed the present action, alleging Israeli Rabbinical Judges and officials of the Rabbinical Court aided and abetted in the kidnapping of his daughter. The U.S. State Department opined that Israeli Rabbinical Judges and officials of the Rabbinical Court were entitled to immunity because they were acting within the scope of their duties for the Israeli rabbinical courts. The Appellate Division ruled that the State’s Department’s ruling was binding and that foreign officials were entitled to sovereign immunity for acts taken within the scope of their official duties.
