In a Decision – Rosenberg v. Rosenberg (an "Unreported Decision") >> the Court Held:
The Appellate Division affirmed the Trial Court’s denial of Husband’s demand to be relieved of alimony obligation as that was what was specifically bargained for in the Divorce Agreement.
The Appellate Division accepted the Trial Court ruling the anti-Lepis provision of the PSA and the alimony provisions were specifically bargained-for in exchange for Wife surrendering her right to permanent alimony. The anti-Lepis provision was an integral and essential part of the parties' bargain. The appellate court also reasoned there is a "strong public policy favoring stability of arrangements" in matrimonial matters. The appellate court too concluded that there was insufficient evidence to show Husband was not aware of the alleged cohabitation when the parties entered into the Divorce Agreement.
