The Appellate Division determined that the Trial Court’s preclusion of the other parent taking the child to another religious institution was not proper.
The court considered whether defendant interfered with plaintiff’s right as the custodial parent to raise the children in the Roman Catholic Faith when he took the daughters to a nondenominational Christian church, found he did not and that the motion judge’s order unduly restricted defendant’s religious freedom. The motion judge’s order interpreted the language of the MSA too broadly and essentially imposed an obligation on defendant to practice plaintiff’s religion.right to obtain counsel and providing the opportunity for defendant to obtain counsel if he or she wished.
