In a Decision – Roth v. Roth, , (an "Unreported Decision") >> the Court Held:
The Appellate Division concluded that when the defaulted Husband failed to participate in the divorce proceeding, Wife was not automatically entitled to a default judgment that granted all requests regarding equitable distribution. The court similarly rejected Wife’s argument that the trial judge erred by permitting Husband's attorney to cross-examine her at the default hearing. The court reasoned that although the entry of a default ordinarily precludes a defendant from offering testimony or other evidence, it did not obviate the plaintiff's obligation to furnish proof on the issues.
