In a Decision E.V. v. L.G., (an "Unreported Decision") >> the Court Held:
The Appellate Division affirmed the finding of Domestic Violence.
The judge noted that although there was no complaint of prior violence, the litigation and tension between the parties and the fact that the assault occurred in a courtroom supported the issuance of an FRO. On appeal, the court affirmed the lower court's decision. Wife admitted to the assault and the evidence showed an FRO was necessary in order to stop the escalation of conflict between the parties.
