The Appellate Division affirmed the Trial Court’s finding that the Bad Faith of Wife in the Divorce litigation warranted the award of attorney’s fees against Wife.
The court also agreed with the trial court's finding that the plaintiff acted in bad faith. The court's reasoning was that the plaintiff failed to comply with a pendente lite order and forced the defendant to incur counsel fees to file an enforcement motion. The court found that that plaintiff also failed to comply with a case management order and did not submit documents that would have assisted in settlement. The court also found that the trial court's finding of bad faith was supported by the plaintiff's conduct throughout the litigation where he failed to accurately report his income and the value of his business.
