In a Decision – L.E. v. K.E.W.,, (an "Unreported Decision") >> the Court Held:
The Appellate Division affirmed the Decision of the Trial Court determining that as to Domestic Violence, Defendant was a ‘Household Member’.
Defendant created a hoax to make Plaintiff believe Defendant was terminally ill with cancer (and later told Plaintiff he was to have a heart transplant). Plaintiff brought Defendant to her house when Defendant was allegedly released from hospital. Plaintiff eventually realized she was being deceived. Trial judge found Plaintiff credible, Defendant not credible, Defendant was a "household member" for purposes of the PDVA, the fake illness was the predicate act of harassment and the FRO was needed to stop defendant victimizing Plaintiff and others. The Appellate Division determined that Defendant intruded on private aspects of Plaintiff's life. The Appellate division remanded to clarify whether the need to protect victim and her family was sufficient to warrant entry of an FRO.
