The Appellate Division affirmed the Family Part determination that no paternity testing would be ordered against a former paramour 10 years after her divorce where her ex-spouse was named as the father.
Spouse and paramour both denied plaintiff's account of the frequency of their sexual encounters with her. The court noted that the trial court found spouse and paramour to be credible and plaintiff to be not credible and to be motivated by her enmity for former spouse.
