In a Decision – P.C. v. R.C., (an "Unreported Decision") >> the Court Held:
The Appellate Division affirmed the Decision of the Trial Court granting a
Domestic Violence Order.
The Appellate Division determined that the Trial Court’s findings as to credibility were binding because it is the trial judge who sees and observes the witnesses, thereby possessing a better perspective than a reviewing court in evaluating the veracity of witnesses. The court also noted the record overwhelmingly supported the determination that Wife was in need of an FRO to protect her from further domestic violence.
