The Appellate Division reversed and remanded the case because Defendant was not permitted an adjournment to obtain counsel.
The court found trial judge erred in denying defendant's request for an adjournment to retain counsel. Even though the matter was beyond the expected ten (10) day time period to conclude a Domestic Violence matter, the party requesting the adjournment to obtain counsel was not responsible for the delay and the request was presented at the first appearance by the party. Moreover, protection was still afforded by the Temporary Restraining Order.
