The Appellate Division affirmed because New Jersey previously acquired jurisdiction over the child.
Defendant moved to have the oldest child declared emancipated. His motion was denied because the child was found to be a fulltime college student. The Appellate Division noted that in 2007 New Jersey obtained modification and enforcement jurisdiction over defendant's child support obligation. The court found no legal support to preclude New Jersey courts from enforcing and modifying the parties' child support order in accordance with New Jersey law instead of Colorado law.
